HomeMy WebLinkAboutCity Council Resolution 1991-355CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of July 19 91 The following members were present: rIa or Berpmn, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 91-355 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR THOMPSON LAND DEVELOPMENT/A DIVISION OF U.S. HOME CORPORATION FOR BRIDLEWOOD FARMS. (90028) (RPUD 90-2) WHEREAS, the City Council has approved the Final Plat and Development Contract for Thompson Land Development/A Division of U.S. Hone Corporation for Bridlewood Farms., a plat of 68 single family detached lots and 7 outlots located in the southeast quadrant of Medina Road and the west City Limits; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and trail paving costs and according to the Dedication Policy in effect at the time of filing of the Final Plat. 4. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Removal of existing structures at the developer's expense. 7. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. Page Two Resolution No. 91-355 File 90028 8. Submittal of required utility and drainage easements as approves' by the City Engineer prior to filing the Final Plat. 9. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County, provided that permits may be issued for one model home. 10. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City, shall be filed with the Final Plat and evidence of filing shall be submitted prior to issuance of permits. 11. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 90-2 per Section 9 of the Zoning Ordinance. 12. Private drive access shall be limited to internal public roads and prohibited from Medina Road. 13. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. 14. The Developer shall comply with those provisions of Resolution 89-439 regarding tree preservation that apply. 15. Minimum yard setbacks shall be 35 for from the front yards, except 30 feet for Lots 10, 11, and 12, Block 7 and Lots 1-8, Block 1; 10 feet for all side yards; and, 25 feet for rear yards. All yard minimum setbacks to Medina Road shall be 50 feet.
