HomeMy WebLinkAboutCity Council Resolution 1991-353CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of July . 19_9L_ The following members were present: Thome following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 91- 353 DENYING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR BATON CORPORATION FOR MISSION RPUD. (89103) (RPUD 76-1) WHEREAS, Baton Corporation has requested approval for an amendment of the Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for Mission RPUD relative to dwelling unit densities, styles, and location southeast of Larch Lane and old Rockford Road; and, WHEREAS, the applicant submitted two plans over a period of two years. WHEREAS, the Planning Commission has reviewed said requests at duly called Public Hearings; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby does deny the Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit Amendment for Baton Corporation for Mission RPUD located southeast of Larch Lane and Old Rockford Road, based on the following reasons: 1. Insufficient demonstration of more efficient and effective use of streets, utilities and public facilities to yield high quality development. 2. Recreation facilities and other public and common facilities are not more usable and suitably located than would otherwise be provided under conventional land development procedures. 3. Insufficient demonstration of affirmative design efforts toward the preservation and enhancement of desirable natural site characteristics as defined by the Plymouth "Physical Constraints Analysis", particularly encroachment on natural topography south of 41st Avenue North. 4. The Plan proposes credit for and a concentration of low -to -moderate income "bonus units" without demonstration that such "bonus units" defined in the Zoning Ordinance can and will be developed. (see next page) Page Two File 89103 Resolution No. 91-353 5. The applicant has provided no evidence that the approved RPUD plan is improper, inadequate, and, thus, in need of corrective amendment. 6. The balance of the RPUD can be developed within the approved density and general design standards. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker and upon vote being taken thereon, the following voted in favor thereof: mayor Bergman, Counrilm ethers Helliwell Ricker Vasiliou and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
