Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota was held on the 1St day of JU1Y
1991. The following members were present: Mayor Ber ian, Councilmembers Helliwell, ,
Ricker. Vasiliou. and Zitur
The following members were absent: None
COuncilmember Ricker introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 91- 352
AUTHORIZIUG THE VACATION OF A PORTION OF
A STREET RIGHT-OF-WAY (13TH AVENUE/SOUTH SHORE DRIVE)
WHEREAS, a petition was received to vacate a portion of a street right-of-way adjacent
to Lots 8, 9, 10 and 11 East Medicine Lake Addition, (Section 25, Township 118, Range
22, Hennepin County); and
WHEREAS, a public hearing with respect to said vacation was scheduled for July 1, 1991
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of July 1, 1991; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on July 1, 1991 to inform any and all
interested parties relevant to the vacation of a street right-of-way (13th Avenue/South
Shore Drive); and
WHEREAS, it was determined by the City Council that a portion of said rigt-of-way was
not needed for public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the following street right-of-way be vacated:
Legal Description of road to be vacated: That part of Government Lot 4, Section 25,
Township 118, Range 22, Hennepin County, MN described as follows:
1. Beginning at the southeast corner of Lot 11, East Medicine Lake Addition,
according to the recorded plat thereof, Hennepin County, MN; thence on an
assumed bearing of south 67 degrees, 02 minutes, 00 seconds west along the
southerly line of said Lot 11, a distance of 86.80 feet to the southwest
corner of said Lot 11; thence south 26 degrees, 35 minutes, 42 seconds east
a distance of 10.00 feet; thence easterly along a non-tangential curve
concave to the south having a radius of 569.50 feet a central angle of 09
degrees, 07 minutes, 13 seconds, and a chord bearing of north 77 degrees, 57
Minutes, 55 seconds east an arc distance of 90.65 feet; thence north 25
degrees, 06 minutes, 00 seconds west a distance of 27.13 feet to the point
of beginning;
and

11, East Medicine Lake Addition according to the recorded plat thereof,
Hennepin County, MN; thence on an assumed bearing of south 67 degrees, 02
minutes, 00 seconds west along the southerly line of said Lot 11, a
distance of 86.80 feet to the southwest corner of said Lot 11; thence south
16 degrees, 35 minutes, 42 seconds east a distance of 10.00 feet; thence
easterly along a non-tangential curve concave to the south having a radius
of 569.50 feet a central angle of 09 degrees, 07 minutes, 13 seconds and a
chord bearing of north 77 degrees, 57 minutes, 55 seconds east an arc
distance of 90.65 feet to the point of beginning of the land to be
described; thence continuing on the easterly extension of the last
described curve having a radius of 569.50 feet, a central angle of 09
degrees, 27 minutes, 04 seconds and a chord bearing of north 87 degrees, 15
minutes, 03 seconds east an arc distance of 93.94 feet to the southerly
line of Central Avenue as platted in East Medicine Lake Addition; thence

2. That said vacation shall not affect the authority of any person, corporation
or municipality owning or controlling the electric or telephone poles and
lines, gas and sewer lines, or water lines, mains and hydrants thereon or
thereunder, to continue maintaining the same, to enter upon such way br
portion thereof vacated to repair, replace, remove otherwise attend thereto.
3. Subject to the vacated street being combined with each of the adjacent
parcels by Hennepin county as described in the above descriptions.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Ricker , and upon vote being taken thereon, the following voted
in favor thereof: Mayor Berg . Councilmembers Helliwell, Ricker, Vasiliou, ,
and Z itur
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
