Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 3rd day
of June , 19 91 The following members were present:

Councilmemb r introduced the following Resolution and
moved its adoption:
RESOLUTION 91- 313
APPROVING SITE PLAN AMENDMENT AND ZONING ORDINANCE VARIANCES FOR JEFF ROBERS
FOR FEC, INC. (91034)
WHEREAS, Jeff Robers has requested approval for a Site Plan Amendment and
Variances for parking setback (east and south), sign area and height, and
policy regarding private required landscaping located in the public right-of-
way for FEC, Inc. for property located 2765 Niagara Lane North; and,
WHEREAS, the Planning Commission has reviewed said request and recommends
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Jeff Robers for FEC, Inc. a Site Plan Amendment and Variances for property
located 2765 Niagara Lane North, as follows, subject to the following
conditions:
1. Compliance with the City Engineer's Memorandum.
2. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm
water drainage facility.
3. Submission of required financial guarantee and Site Performance Agreement
for completion of site improvements within 12 months of the date of this
resolution.
4. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
5. Compliance with the Ordinance regarding the location of fire hydrants and
fire lanes.
6. All waste and waste containers shall be stored within the structure, and
no outside storage is permitted.
7. An 8k x 11 inch "As Built" Fire Protection Plan shall be submitted prior
to the release or reduction of any site improvement bonds per City Policy.

8. The following variances are granted based on the finding that the Zoning
Ordinance variance criteria has been met on that:
a. The reconstruction and relocation of the existing 54 foot silo/sign at
the southwest corner of the site subject to applicable setback and
structural requirements versus the Zoning Ordinance maximum height of
36 feet and sign area of 96 square feet.
b. A 5 foot minimum parking setback from and along the east property line
versus the Zoning Ordinance standard of 50 feet.
c. A parking setback on the south property line of 15 feet at the west
edge of the existing parking area, and tapering westerly to 25 feet at
the west property line versus the Zoning Ordinance standard of 25
feet.
d. Location of landscaping in the public trail outlot parallel to Niagara
Lane as a variance from the Plymouth Landscape Policy (Resolution 81-
273).
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmen r and upon vote being taken thereon,
