HomeMy WebLinkAboutCity Council Resolution 1991-311CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was hel on the 3rd day of June 19 91 The following members were present: M�ayor�Bergrian Councilmembers Helliwell Ricker Vasiliou and Zitur The following members were absent: None Moor Bergman introduced the following Resolution and moved its adoption: RESOLUTION 91-311 APPROVING RESIDENTIAL PLANTED UNIT DEVELOPMENT PLAN CONDITIONAL AND USE PERMIT AMENDMENT FOR TOM BISHOP (91029) (RPUD 84-6) WHEREAS, Tom Bishop has requested approval of a Planned Unit Development Plan Conditional Use Permit amendment for property located at 10690 45th Avenue North to allow for reduced setbacks from 25 feet to 15.5 along the northeast property line for the construction of an enclosed porch; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Tom Bishop for a Planned Unit Development Plan Conditional Use Permit amendment to allow reduced setbacks for an enclosed porch on property located at 10690 45th Avenue North, subject to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no Code requirements are waived by this approval. 3. The granting of the permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. The situation is unique relative to the location of the house on the lot. 4. An enclosed porch is allowed on Lot 31, Block 3; Woodlands Addition with a minimum setback of 15.5 feet from the northeast property line. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell, Ricker Vasiliou and Zitur T e following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
