Pursuant to due call and notice thereof, a _ regular meeting of the
City Council of the City of Plymouth, Minnesota, was he on the 3rd_ day

Councilmember Ricker introduced the following Resolution and
moved its adoption:
RESOLUTION 91- 297
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
GONYEA LAND COMPANY FOR "CURTIS LAKE ADDITION" LOCATED BETWEEN I-494 AND WEST
MEDICINE LAKE DRIVE (NORTHWEST BOULEVARD) AT 45TH AVENUE NORTH (90105)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Gonyea Land Company for "Curtis Lake Addition" located between I-494 and
West Medicine Lake Drive (Northwest Boulevard) at 45th Avenue North;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat for Gonyea Land
Company for "Curtis Lake Addition" located between I-494 and West Medicine
Lake Drive (Northwest Boulevard) at 45th Avenue North.
1. Complia►.ce with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of .
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. No yard setback variances are granted or implied. Minimum yard setbacks
are 35 feet for front yards, 10 feet and 10 feet for side yard setbacks
and 15 feet for rear yard setback.

8. Approved variances are for the dedication of one-half of the right-of-way
for Vinewood Lane adjacent to Lots 1-6, Block 2 and for a 1,161 foot long
cul-de-sac for Vinewood Lane south of 46th Avenue North..
9. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
10. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
11. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
12. Private drive access shall be limited to internal roads and restricted
from Northwest Boulevard (West Medicine Lake Drive).
13. There shall be no private drive access to Underwood Lane for Lot 2, Block
2, or Lot 1, Block 3 without construction of a temporary cul-de-sac at the
north end of Underwood Lane.
14. A temporary roadway easement over Lot 13, Block 1, shall be submitted and
approved by the City Attorney prior to the recording of the Final Plat.
15. Prior to recording'of the Final Plat the petitioner shall provide an
easement for street, storm drainage and utilities from property south of
the parcel sufficient in width to, when combined with the Vinewood Lane
platted hereby, totally 50 foot right-of-way for Vinewood Lane over the
entire length of the parcel.
16. Compliance with City Council Resolution 89-439 regarding tree
preservation.
The motion for adoption of the foregoing Resolution was duly seconded
by and upon vote being taken thereon,
