HomeMy WebLinkAboutCity Council Resolution 1991-294CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of ,lune , 1991 The following members were present: Mayor Bergman, Councilmembers Helliwell Ricker Vasiliou d Zitur The following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 91-294 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR LUNDGREN BROS. CONSTRUCTION CHURCHILL FARMS (90009) (RPUD 90-1) WHEREAS, the City Council has approved the Final Plat and Development Contract for Churchill Farms; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: I. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Plat with Hennepin County. 4. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Removal of existing structures at the developer's expense. 7. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 8. No yard setback variances are granted or implied except as listed herein. 9. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County,except that a single building permit may be issued for a model home on Lot 5, Block 2 prior to recording of the Final Plat. Access to the lot may be to County Road 24 using the existing driveway only, until 31st Avenue North access is constructed use of the dwelling as a model and sales office shall be subject to ordinance standards. 11. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 12. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 90-1 per Section 9 of the Zoning Ordinance. 13. Access shall be limited to internal public roads and prohibited from County Road 24. 14. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. 15. A 30 minimum foot front yard setback is granted on the following lots: Block 2, Lots 1 and 12 (31st Ave. N. side only) Block 2, Lots 2-11 Block 5, Lots 1 and 2 Block 6, Lot 2 16. Compliance with the provisions of City Council Policy Resolution 89-439. 17. The location of the five foot high fences in front yards and on lots without a principal use is approved in conformance with the approved Final Plan. Fences are not permitted within the "sight triangles" at street intersections. 18. Four identification signs on_y are approved, in conformance with the Final Plan and the applicant's narrative of April 24, 1991. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Counrilmemhers Helliwell Ricker Vasiliou and Zitur The following voted against or abstained None Whereupon the Resolution was declared du y passed and adopted.
