HomeMy WebLinkAboutCity Council Resolution 1991-292CITY OF PLYMOUTH Pursuant to due call and notice thereof, a r'lular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day Of _,Tune 19 91 The following members were present: Mayor perpan, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 91-292 APPROVING AMENDMENT TO RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN CONDITIONAL USE PERMIT FOR LUNDGREN BROS. CONSTRUCTION COMPANY FOR CHURCHILL FARMS (90009) (RPUD 90-1) WHEREAS, Lundgren Bros. has requested approval of a Planned Unit Development Plan and Conditional Use Permit amendment for property located at County Road 24 at Brockton Lane to allow for five foot fences within front yard setbacks and on lots without a principal use; four project monument signs; a private trail in the public right-of-way of Zircon Lane; and, a flagpole, light, and lattice fence in the Zircon Lane median; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lundgren Bros. Construction Company for a Planned Unit Development Plan Conditional Use Permit amendment to allow the following amendments subject to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no Code requirements are waived by this approval. 3. The granting of the permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. 4. The location of five foot high fences in front yards and on lots without a principal use is approved in conformance with the approved Final Plan. Fences are not permitted within the "sight triangles" at street intersections. (see next page) Resolution No. 91-292 Page Two File 90009 5. Four identification signs oEly are approved, in conformance with the Final Plan and the applicant's narrative of April 24, 1991. 6. A 30 foot minimum front yard setback is approved on the following lots based on a finding that the reduced setback will result in significant preservation of existing trees on the site: Block 2, Lots 1 and 12 (31st Avenue N. Side Only) Block 2, Lots 2-11 • Block 5, Lots 1 and 2 Block 6, Lot 2 7. Compliance with the applicable conditions of City Council Resolution 90- 262 (RPUD Preliminary Plat and Conditional Use Permit) The motion for adoption of the foregoing Resolution was duly seconded bymember and upon vote being taken thereon, the o ow ng vote in avor thereof: Ma RerMan.
