Pursuant to due call and notice thereof, a reglilar meeting of the City Council of
the City of Plymouth, Minnesota was held on the 71ct day of MPIL
1991. The following members were present: Mayor Bergman, Councilmembers Helliwell
Ricker, and Vasiliou '
The following members were absent: Councilmember Zitur
Councilmember Vasiliou introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 91-271
AUTHORIZING THE VACATION OF DRAINAGE AND UTILITY EASEMENT
DOCUMENT NO. 1661568
WHEREAS, a petition was received to vacate a certain drainage and utility easement in
Parcel 19-118-22-23-0004; and
WHEREAS, a public hearing with respect to said vacation was scheduled for May 21, 1991
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of May 21, 1991; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
4 mail; and
WHEREAS, the Council did hold a public hearing on May 21, 1991 to inform any and all
interested parties relevant to the vacation of a certain drainage and utility easement
in Parcel 19-118-22-23-0004; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the following drainage and utility easement be vacated:
All of the drainage and utility easements created by Document No. 1661568 over, under
and across the north 6 feet, the west 6 feet, the east 6 feet and the south 10 feet of
the following described parcel:
The east 680 feet of the south 363 feet of the following described tract
said south 363 feet being measured from the south line of the northwest 1/4
of Section 19, that part of the northwest 1/4 of the northwest 1/4 and the
southwest of the northwest 1/4 of Section 19, Township 118, Range 22
described as follows: Beginning at the southwest corner of the northwest
1/4 of said Section 19; thence east along the south line of said northwest
1/4 a distance of 775 feet; thence north at a right angle 363 feet; thence
west at a right angle 160 feet; thence north at a right angle 190 feet;
thence east at a right angle to the east line of the west 1,217.90 feet of
said northwest 1/4; thence north along said east line to the center line of m

34th Avenue North as dedicated in the plat of Amber Woods; thence west at a
right angle to the west line of said northwest 1/4; thence south along said
west line to the point of beginning according to the Government survey
thereof.
The motion for the adoption of the foregoing Resolution was duly seconded by
Cotmcilmember Helliwell , and upon vote being taken thereon, the following voted
in favor thereof: Mayor Berman Councilmembers Helliwell, Ricker. and Vacilirni ,
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
