Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota was held on the 71g„t day of h4av
1991. The following members were present:
Mayor Bergman, Councilmembers Helliwell Ricker. and Va iliou
The following members were absent: Councilmember Zitur
Cotmcilmember Vasiliou introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 91-270
AUTHORIZING THE VACATION OF DRAINAGE AND UTILITY EASEMENT
DOCUMENT NO. 4027270
WHEREAS, a petition was received to vacate a certain drainage and utility easement in
Parcels 19-118-22-23-0004 and 19-118-22-23-0005; and
WHEREAS, a public hearing with respect to said vacation was scheduled for May 21, 1991
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of May 21, 1991; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on May 21, 1991 to inform any and all
interested parties relevant to the vacation of a certain drainage and utility easement
in Parcels 19-118-22-23-0004 and 19-118-22-23-0005; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the following drainage and utility easements be vacated:
Description of center line of 60 foot wide drainage and utility easement to
be vacated created by Document -No. 4027270.
Commencing at the southwest corner of the northwest 1/4 of Section 19,
Township 118, Range 22; thence easterly along the south line thereof to the
southeast corner of the west 75 acres of said northwest 1/4; thence
northerly along the east line thereof a distance of 1,020 feet to the actual
point of beginning; thence deflecting left 94 degrees a distance of 72 feet;
thence deflecting left 44 degrees 40 minutes a distance of 535 feet; thence
deflecting left 18 degrees 0 minutes a distance of 340 feet; thence
deflecting right 17 degrees 35 minutes to the point of intersection with the
south line of the northwest 1/4 and there terminating.
Description of Parcel
That part of the northwest 1/4 of Section 19, Township 118, north Range 22,
west described as follows: Beginning at the southwest corner of said
northwest 1/4; thence east along the south line thereof 775 feet; thence

north at a right angle 363 feet; thence west at a right angle 160 feet;
thence north at a right angle 190 feet to the north line of the south 553
feet thereof; thence east along the north line of said south 553 feet to the
west line of Amber Woods; thence north along the west line of said plat to
the intersection with the center line of 34th Avenue North; thence west at a
right angle with said west line of the plat to the west line of said
northwest 1/4; thence south along the west line of said northwest 1/4 to the
point of beginning.
Excepting from said vacation the dra;na2e and utility easement within the
following described parcel:
That part of the south 553 feet of the southwest 1/4 of the northwest 1/4 of
Section 19, Township 118, Range 22 that lies easterly and northerly of the
following described line:
Commencing at the southwest corner of said northwest 1/4; thence east along
the south line of said southwest 1/4 of northwest 1/4 a distance of 895 feet
to point of beginning of the line to be described; thence deflecting left 90
degrees a distance of 363 feet; thence deflecting left 90 degrees a distance
of 280 feet; thence deflecting right 90 degrees a distance of 190 feet to
the north line of the south 553 feet of the southwest 1/4 of the northwest
1/4 and there terminating and lies west of the west line and same westerly
line extended south of Amber Woods except road.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilwmber Helliwell , and upon vote being taken thereon, the following voted
in favor thereof: Mayor Bergman. Councilmembers Helliwell, Ricker, and Vasiliou ,
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
