HomeMy WebLinkAboutCity Council Resolution 1991-202REVISED 4-22-91 CITY OF PLYMOUTH Pursuant to due call and notice thereof, a re lar meeting of the City Council of the City of Plymouth, Minnesota, was held on the 22nd day of April 19 91 The following members were present: Mayor Bergppn, Councilmembers Helliwell Ricker Vasiliou and Zitur The following members were absent: None Councilmember Helliwell introduced the following Resolution and moved its adoption: RESOLUTION 91- 202 APPROVING SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR TOBIN REAL ESTATE COMPANY (91005) WHEREAS, Tobin Real Estate Company has requested a Site Plan Amendment and Conditional Use Permit for temporary outside storage of 10 truck trailers; construction of 15 new offstreet parking spaces; elimination of 2 previously approved parking spaces; and relocation of proof -of -parking for property located at 13310 Industrial Park Boulevard; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Tobin Real Estate Company for a Site Plan Amendment and Conditional Use Permit for temporary outside storage of truck trailers for property located at 13310 Industrial Park Boulevard, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored within approved designated areas. 5. Any signage shall conform with the City Ordinance standards. 6. There shall be no outside display, sales, or storage of merchandise or related materials other than approved herein. 7. The Conditional Use Permit shall be renewed in one year to assure compliance with the conditions. 8. All parking shall be offstreet in designated areas which comply with the Zoning Ordinance. (see next page) Resolution No. 91-202 Page Two File 91005 9. A maximum of 10 semi trailers may be stored only at the trailer storage area designated on the Site Plan. Storage of goods or materials inside of trailers on the site is prohibited, and no repair/maintenance shall be undertaken outside of the principal structure. 10. The provisions of the Zoning Ordinance, Section 11, Subdivision A, paragraph 11, with respect to a Site Performance Agreement and financial guarantee shall be met prior to issuance of a grading permit. 11. Screening of the truck trailers from the adjacent I-1 zoned property is not required. 12. An 8 1/2 x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. The motion for adoption of the foregoing Resolution was duly seconded by C4mrilmember Zitur and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers UelliVC11, Ricker, siliou and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
