The following members were present: , Mayor Bergman, Councilmembers Helliwell, Ricker. Vassi_liou- and 7;tur , The following members were absent: None Councilmember Zitur its adoption: introduced the following Resolution and moved RESOLUTION NO. 91-1.65 RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT 1990 STREET RECONSTRUCTION PROGRAM CITY PROJECT NO. 001 WHEREAS, by a resolution passed by the Council on March 18, 1991, the City Clerk was directed to prepare a proposed assessment of the total cost of the following improvements: Streets within an area south of 29th Avenue North, west of Jewel Lane, north of 25th Avenue North, and east of Urbandale Lane, also an area south of County Road No. 9, west of State Highway 169, north of 36th Avenue North, and east of Union Terrace Lane, and an area south of 26th Avenue North, west of State Highway 169, north of 17th Avenue North, and east of East Medicine Lake Boulevard within the City of Plymouth, Minnesota by the installation of reconstructed bituminous streets with repair of existing concrete curb and gutter, and the installation of new bituminous streets with concrete curb and gutter, storm sewer, and all necessary appurtenances; and WHEREAS, the Clerk has notified the Council that such proposed assessment has been completed and filed in the office of the City Clerk for public inspection; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. A hearing shall be held on the 22nd day of April, 1991 in the City Council Chambers of the Plymouth City Center, 3400 Plymouth Boulevard, Plymouth, Minnesota at 7:00 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing and shall state in the notice the total cost of the improvement. The Clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment to the city treasurer, except that no interest shall be charged if Resolution No. 91-165 Page Two the entire assessment is paid within 30 days from the adoption of the assessment. He may at any time thereafter, pay to the city treasure the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. The motion for the adoption of the foregoing Resolution was duly seconded by Cmmcilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou. and Zitur The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted. 3 fi
