HomeMy WebLinkAboutCity Council Resolution 1991-158CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 18th day of March , 1991. The following members were present: Mayor Bergman, CoUncilmembers Helliwell Ricker, Vasiliou, and Zitur The following members were absent: None C'ouncilmemher Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 91-1S8 DECLARING PROPERTY SURPLUS AND AUTHORIZING SALE WEST MEDICINE LAKE DRIVE WHEREAS, the State of Minnesota deeded to the City, West Medicine Lake Drive right-of- way recorded as Document No's 5516228 and 200813; and WHEREAS, a portion of the West Medicine Lake Drive deeded to the City will no longer be necessary for the road; and WHEREAS, development plans have been approved for Bass Lake Terrace Addition adjacent to the right-of-way; and WHEREAS, it is in the best interest of the City to transfer ownership of property. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA AS FOLLOWS: 1. That the portion of the property north of the south lot line of Lot 9, Block 4 and its westerly extension to the north plat line at Bass Lake Terrace described in Document No's. 5516228 and 2008103 is hereby declared as surplus property. 2. That the Mayor and City Manager are authorized to execute a deed transferring ownership of the property to the owner of the immediate adjacent property. 3. The right-of-way adjacent to Bass Lake Terrace Addition will be combined with Lots 1 through 9, Block 4. 4. The temporary street access across Outlot A must be paved prior to the City vacating the roadway rights as described in the deed from the State of Minnesota to the City of Plymouth. 5. Permanent barricades shall be constructed by the owners of Bass Lake Terrace Addition north of the temporary street access on West Medicine Lake Drive. 6. Utility easements for all utility companies will be retained by the City over that portion deeded to the developer of Bass Lake Terrace Addition. The motion for the adoption of the foregoing Resolution was duly seconded by r- mcilmPmber Vasiliw — , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell. Ricker.Vasiliou and Zitur , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
