HomeMy WebLinkAboutCity Council Resolution 1991-156CITY or PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 18th day of March, 1991. The following members were present: _Mayor Bergman. Coun:jjMgMa=" Helliwell, Ricker, Vasiliou, and Z+tur The following members were absent: None Couneilmember Zitur, introduced the following Resolution and moved its adoption: RESOLUTION 91-156 RESOLUTION AUTHORIZING ABATEMENT OF VIOLATION OF CITY CODE SECTION 2010.01 AT 11605 28TH AVENUE NORTH. WHEREAS, the City passed on Ordinance under Section 2010.01, Nuisances, which states that permitting, suffering, or maintaining any fence, wall, plantings, landscape materials, or any other item within 20 feet of any street right-of- way corner which interferes with or obstructs traffic visibility, would constitute an intersection sight obstruction; and, WHEREAS, the property at 11605 28th Avenue North is owned by a Gregory and Karen Cole, has a hedge that borders the property and extends into the public right-of-way and is in violation of City Code Section 2010.01; and, WHEREAS, The Cole's have been notified by certified mail that his hedge along Evergreen Lane and 28th Avenue North causes an intersection sight obstruction and is violation of City Code; and, WHEREAS, the City permitted the Cole's at least 30 days to bring the violation into compliance with the City Code; and, WHEREAS, after at least 30 days a reinspection of the property was conducted and found that the violation had not been corrected. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does authorise the City to abate the nuisance at a coat of approximately $ 275.00 for labor as estimated by City Forester to remove the sight obstruction violation at 11605 28th Avenue North; FURTHER, that the property owners will be personally liable for costs and administrative fees to remove that violation, per City Code Section 2010.01. The motion for adoption of the foregoing Resolution was duly seconded by Conn sili ou , and upon vote being taken thereon, the following voted in favor thereof: _ ayor BerSmp, Council—hers Helliwell, Ricker, Van iliou, and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
