Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 18th day of
Marc ti, 1991. The following members were present: Mayor Bergman'
Council_membAra Helliwell, Ricker, Vasilinu- and Zitur
The following members were absent _ None
Councilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 91-155
RESOLUTION AUTHORIZING ABATEMENT OF VIOLATION OF CITY CODE SECTION 2010.01 AT
3830 UNION TERRACE LANE NORTH.
WHEREAS, under the City Code Section 2010.01, Nuisances, the following acts
are declared a Public Nuisance: permitting, suffering, or maintaining any
fence, wall, plantings, landscape materials, or any other item within any
street right-of-way corner which interferes with or obstructs traffic
visibility, is considered an intersection sight obstruction; and,
WHEREAS, at the property at 3830 Union Terrace Lane, owned by Mr. and Mrs.
Kenneth Augst, there are juniper shrubs in the public right-of-way and on
private property in violation of the City Code 2010.01; and,
WHEREAS, the owner has been notified by certified mail that the shrubbery
along Union Terrace Lane and 39th Avenue North constitutes an intersection
sight obstruction in violation of the City Code; and,
WHEREAS, the owner has had at least 30 days to bring the violation into
compliance with the City Code; and,
WHEREAS, after at least 30 days an inspection of the property was conducted
and the violation had not been corrected.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does authorize the City to
abate the nuisance at a cost of approximately $75 for labor as estimated by
City Forester, to remove the sight obstruction violation at 3830 Union Terrace
Lane North;
FURTHER, the owner will be personally liable for costs and administrative fees
to remove the violation, per City Code Section 2010.01.
The motion for adoption of the foregoing Resolution was duly seconded
by Ceun_ci�+�•+�+►+er Vaai 7 i n„ , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Bergp�a_n, Councilmembera
Helliwell, Ricker, Vaailiou, and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
