HomeMy WebLinkAboutCity Council Resolution 1991-141CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 4th day of March 1991. The following members were present: Mayor Bereman. CO mcilmembers Helliwell Ricker- Vasiliou, and Zitur ' The following members were absent: Nnne Crn mcilmemher Ricker introduced the following Resolution and moved its adoption: RESOLUTION NO. 91-141 DECLARING FINDING OF NO NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED JANUARY 14, 1991 FOR NORTHWEST BOULEVARD BETWEEN 45TH AVENUE AND 54TH AVENUE WHEREAS, pursuant to Minnesota Environmental Quality Board (EQB), Rule No. 5, Chapter 4410.4300, Sub Part 27A, the environmental review process, the City of Plymouth, as the responsible governmental unit, submitted an Environmental Assessment Worksheet (EAW) for Northwest Boulevard and Schmidt Lake Road on January 14, 1991; and WHEREAS, the 30 day review comment period expired on February 20, 1991 and all comments and recommendations received from reviewing agencies and other interested parties have been considered; and WHEREAS, in accordance with the Environmental Quality Board rules the EAW was required because of encroachment into a DNR protected wetland; and WHEREAS, the City has received concurrence from the Metropolitan Council and Minnesota Department of Natural Resources, there is :)o need for an Environmental Impact Statement; and WHEREAS, the City has conducted traffic studies which indicate the road is necessary to provide adequate traffic circulation for development of the area in accordance with the City's Land Use Guide Plan; and WHEREAS, the concept of the roadway is in accordance with the City's Thoroughfare Guide Plan, originally adopted in 1972 with the current plan revised in 1989; and WHEREAS, alignment alternative AD of the four alternatives considered for Northwest Boulevard has the least impact on the wetland areas; and WHEREAS, alignment alternative SLR1 of the two alternatives considered for Schmidt Lake Road has the least overall negative impact; and WHEREAS, avoidance, minimization and mitigation measures for encroachment into protected wetlands will be addressed as part of the design and permit process; and WHEREAS, in determining whether the extension of Northwest Boulevard from 45tP Avenue to 54th Avenue has the potential for significant environmental effects, e City Council has considered the following factors: 'sem 1. Type, extent and reversibility of environmental effects; Resolution No. 91- 141 Page Two 2. Cumulative potential effects of related or anticipated future projects; 3. The extent to which the environmental effects are subject to avoidance, minimization and mitigation by ongoing public regulatory authority; 4. The extent to which environmental effects can be anticipated and controlled as a result of other environmental studies undertaken by public agencies of the project proposer, or of EIS's previously prepared on similar projects; and WHEREAS, after comparing the impact that may be reasonably expected to occur as the result of the extension of Northwest Boulevard with the criteria set forth above, the City Council has determined that the proposed project does not present a potential for significant environmental effects. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That it should and hereby does make a negative declaration on the need for an Environmental Impact Statement (EIS) for the proposed extension of Northwest Boulevard from 45th Avenue to 54th Avenue in accordance with alignment AD for Northwest Boulevard. The motion for the adoption of the foregoing Resolution was duly seconded by Coimcilmemher Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor RerggLn, Comcilmembers Helliwell, Ricker—Vasili_ou. , and 7itsrr The following voted against or abstained: Non Whereupon the Resolution was declared duly passed and adopted.
