HomeMy WebLinkAboutCity Council Resolution 1991-124CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4 day of March 19 91 The followintq members were present: HI3-el weil;Ric-re-r—,Ri, Vasiliou, Zi ur, Bergman The following members were absent: None Mayor Bergman introduced the following Resolution and moved its adoption: RESOLUTION 91-124 APPROVING PRELIMINARY PLAT AND VARIANCES FOR JAMES AND CORINNE GUDDAL FOR PROPERTY LOCATED AT 4465 VICKSBURG LANE (90087) WHEREAS, James and Corinne Guddal have requested approval for a Preliminary Plat and Variances a plat for 3 lots on 1.28 Acres, located at 4465 Vicksburg Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby does approve the request by James and Corinne Guddal for a Preliminary Plat and Variances for a 3 -lot plat on 1.28 Acres, located at 4465 Vicksburg Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication for two lots in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. Incorporation of tree protection provisions in the Final Plat and Development Contract approval. 9. A variance is granted for a 75 foot lot width for Lot 2, and a 58 foot lot width for Lot 3, based on the following findings: (see next page) File 90087 Page Two a. Strict enforcement of the minimum lot width would deprive the applicant of the reasonable use of the land. b. That the conditions upon which the variance is granted are unique to this site and are not applicable, generally, to other property within this Zoning District. c. The granting of the variance will not be detrimental to the public welfare or injurious to other property. 10. A variance from the Shoreland Management District is granted for a 58 - foot lot width for Lot 3, based on the following conditions: a. Strict enforcement of the minimum lot width would deprive the applicant of the reasonable use of the land. b. That the conditions upon which the variance is granted are unique to this site and are not applicable, generally, to other property within this Zoning District. c. The granting of the variance will not be detrimental to the public welfare or injurious to other property. 11. Access for Lots 1 and 3 from Vicksburg Lane is prohibited and shall be provided via easement from 45th Avenue North, except that temporary access to Lot 1 from Vicksburg Lane may continue, but be eliminated prior to issuance of a building permit to Lot 2 or Lot 3. A covenant shall be prepared by the petitioner and approved by the City Attorney to be recorded on the titles of Lots 1, 2 and 3 evidencing this condition. The Vicksburg Lane access shall be closed when the first building permit application is submitted. 12. In lieu of removal of the existing accessory structures on proposed Lot 2 by the owner prior to filing the Final Plat a covenant, satisfactory to the City Attorney, shall be prepared by the petitioner and recorded on the title of Lot 2, at the time the Final Plat is filed requiring the removal of all accessory structures prior to issuance of a Building Permit for Lot 2. The garage should be removed at the time a building permit application is submitted if the garage does not comply with the Zoning requirements at that time. 13. The City will pay for connecting the storm sewer on the property.
