Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the -4th day of
March, 1991. The following members were present: _ Mayor Bergman.

Couneilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 91-123
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT AND
DEVELOPMENT CONTRACT FOR ORVILLE AND JOYCE MILLER FOR "KINGSWAY ESTATES"
LOCATED AT THE NORTHEAST CORNER OF COUNTY ROAD 6 AND XANTHUS LANE (18630
COUNTY ROAD 6) (90081)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Orville and Joyce Miller for "Kingsway Estates" located at the northeast
corner of County Road 6 and Xanthus Lane (18630 County Road 6) (90081);
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property small be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing of the Final Plat.
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. An approved variance is not to provide frontage on a dedicated street,
based on the following findings:

a. The strict requirement of frontage on a public street would deprive
the applicant of the reasonable use of the land.
b. The variance is necessary for the preservation and enjoyment e -f
substantial property rights of the applicant.
C. The granting of the variance will not be detrimental to the public
welfare or injurious to other property.
8. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
9. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
10. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
11. The Petitioner shall prepare a declaration, to be approved as to form by
the City Attorney that ties Lot 1 to Outlot A so that Outlot A will not go
tax forfeiture, and providing that Outlot A will be conveyed to the City
at such time as the City requires it for a Public Street. The declaration
shall be recorded on the Title of both Outlot A and Lot 1 concurrent with
the recording of the Final Plat.
12. There shall be no driveway entrance from Lot 2 to County Road 6.
The motion for ad--ption of the foregoing Resolution was duly seconded
by Ccuncilmembar Ricker , and upon vote being taken thereon,
the following voted in favor thereof: May Bergman, Counci� rs__
Helliwell, Ricker, Vasiliou, and Litur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
