HomeMy WebLinkAboutCity Council Resolution 1991-060CITY OF PLMSOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 28th day of January, 1991_ The following members were present: _Mayor Bergman. Counellmembera Hell w ll Ricker, and VanjIJo++ The following members were absent: Counci membAy y; Lr Counc;7mwmF..r VaailioL introduced the following Resolution and moved its adoption: RESOLUTION 91-60 APPROVING PRELIMINARY PLAT AND VARIANCES FOR DARREL AND CHRIS GONYEA FOR "CURTIS LAKE" LOCATED AT THE WEST SIDE OF WEST MEDICINE LAKE ROAD (90105) WHEREAS, Darrel and Chris Gonyea has requested approval for a Preliminary Plat for "Curtis Lake", a plat for 64 lots on 49.4 acres and variances to allow the dedication of one-half of the right-of-way for a portion of Vinewood Lane and to allow a cul-de-sac to exceed the minimum standards of the Subdivision Ordinance located at the west aide of West Medicine Lake Road at 45th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby does approve the request by Darrel and Chris Gonyea for a Preliminary Plat and variances to allow the dedication of one-half of the right-of-way for a portion of Vinewood Lane and to allow a cul-de-sac to exceed the minimum standards for "Curtis Lake" for 64 lots located at the west side of West Medicine Lake Road at 45th Avenue North, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. No Final Plat shall be approved until a contract is awarded for public sewer to serve this parcel. Any Final Plat application made prior to when the contract for public sewer is awarded shall be accompanied by a waiver of the 60 -day State Statute regarding processing of Final Plats. 3. No Final Plat shall be approved until the Metropolitan Council has approved the Land Use Guide Plan amendment reclassifying this parcel from LA -3 to LA -2. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. No building permits shall be issued until a contract has been awarded for sewer and water. (see next page) Page 2 Resolution 91-60 6. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 7. Street names shall comply with the City Street Naming System. 8. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 9. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 10. Incorporation of tree protection provisions in the Final Plat and Development Contract approval. 11. Variances are granted for the dedication of one-half of the right-of-way for Vinewood Lane adjacent to Lots 1-6, Block 2 and for a 1,161 -foot long cul-de-sac for Vinewood Lane south of 46th Avenue North, based on the following findings and conditions: a. The strict enforcement of the length of a cul-de-sac would deprive the applicant of the reasonable use of the land. b. The variances are necessary for the preservation and enjoyment of aubatantial property rights of the applicant. C. The granting of the variances will not be detrimental to the public welfare or injurious to other property. d. The petitioner shall provide a temporary easement and construct a temporary street, both consistent with specifications approved by the City Engineer, extending 45th Avenue North easterly to intersect with west Medicine Lake Drive at the existing intersection. This temporary street shall be vacated only upon the construction of 44th Avenue North from Wiest Medicine Lake Drive to Vinewood Lane. e. The petitioner shall provide an easement for street, storm drainage and utilities from property south of the parcel sufficient in width to, when combined with Vinewood Lane platted hereby, total a 50 -foot right-of-way for Vinewood Lane over the entire length of the parcel. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell , and upon vote being taken thereon, the following voted in favor thereof: mayor Berman.
