Pursuant to due call and notice thereof, a t*46i* - special meeting of the Village Council of the Village of Plymouth was held on the Ist day of October 1969 , commencing at 7:30 o'clock P.M. at the +Vgie iiAJ►**,�RQQ*��Ga�iA*1i�i1►Naft*�1ii** Beacon Heights Elementary School 12315 Highway 155 The following members were present: Mayor Hilde, Councilmen Hintz, Humphrey and Kindseth the following members were absent: Councilman Johnson # # f Councilman Humohrev introduced the following resolution and moved its adoption: RESowTIoN No. 69-357 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR TRUNK WATER ON HIGHWAY 055 WHEREAS, pursuant to due and proper notice according to law an assessment hearing was held on the 1st day of October, 1969 relating to Trunk water on Highway #55 Project 068 -OC and, WHEREAS, all persons present desiring to be beard were heard and their objections, if any, were noted NOW, THEREFORE, BE IT HERESY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF DLYMOuTH, MINNESOTA, AS FOLLOWS: "1. The Village Clerk has, with the assistance of the RnnafirTAA Fi A4fi Af"�ArPli engineers heretofore selected by this council for such purpose, calculated the proper amounts to be specially assessed for Trunk water on Highway #55 against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same, 2. Notice has been duly published as required by law that this council would meet in regular session at this time and place to pass on the proposed asseser..ent. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to'any item thereof, and two objections have been filed. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of Trunk water on Highway 1155 Project 1668 -OC in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted_ and confirmed as the proper spacial assessment for each of said lots, pieces or parcels of land respectively. 6. said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for Trunk water on Highway #55 Project #68 -OC 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of AT percent per annum. S. Such assessments shall be payable in 30 equal annual installments payable on the 1st clay of January in each year, beginning in the year 1920_, and continuing until all of said instal ments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 19 69 , To each subsequent installment shall be added interest for one year on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the 1st day of January in each year." The above motion was seconded by Councilman Hintz and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hintz, Humphrey and Rindseth the following voted against: None Whereupon said resolution was declared duly passed and idopted. rrr ,w�rr rrr 2 - STATE OF MINNESOTA ) COUIJTY OF HENNEPIN ) SS.
