HomeMy WebLinkAboutCity Council Resolution 1991-038CITY Or PLMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 11h day of January, 1991. The following members were present: Counc+lm_emh._rs He111Me11T Ricker,, Vasiliou, and Zitur The following members were absent: Mayor Bergman Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION 91-38 POLICY REGARDING REDUCTION OF FINANCIAL GUARANTEES RELATED TO SITE IMPROVEMENT PERFORMANCE AGREEMENTS WHEREAS, Section 11, Subdivision A of the Plymouth Zoning Ordinance specifies that as various portions of work required by a Site Improvemeut Performance Agreement have been completed by the developer and approved by the City, the City Council may, by resolution, release such portion of the financial guarantee as is attributable to such completed work; and, WHEREAS, provide guidance concerning administration of this Ordinance provision the following policy is hereby established: 1. City staff discretion and expertise shall be used in recommending reduction amounts with respect to completion of all work specified in the Site Improvement Performance Agreement except with respect to landscaping, as noted below with regard to landscaping. 2. The amount of the financial guarantee shall not be reduced to less than 25 percent of the amount identified for all landscaping work until all landscaping work required by the Landscape Plan and Site Improvement Performance Agreement is installed and has survived one winter season. The motion for adoption of the foregoing Resolution was duly seconded by _ Co ++. or Zi -ur , and upon vote being taken thereon, the following voted in favor thereof: Counc+ mamers Hel 1 +wel Ip Ri Geri yasiliou. and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
