HomeMy WebLinkAboutCity Council Resolution 1991-030CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 7th day of January 1991. The following members were present: , Councilmembers Helliwell, Ricker, Vasiliou, and Zitur , The following members were absent: Mayor Bergman Councilmember 7itur introduced the following Resolution and moved its adoption: RESOLUTION NO. 91- 30 REQUEST FOR PAYMENT NO. 6 AND FINAL DEEP WELL NO. 12 CITY PROJECT NO. 909 WHEREAS, the City of Plymouth as owner and Berger son -Caswell, Inc., as contractor, have entered into an agreement for Deep Well No. 12, City Project No. 909, said agreement being dated May 24, 1989; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the original contract amount was $150,700. One change order was approved in the amount of $48,920.50 and the value of the work to date is $199,620.50 and is herewith approved. This project overran the contract amount by $48,920.50 or 32.5%. 2. That the work performed by the Contractor for Deep Well No. 12 and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 6 and Final in the amount of $20,110.31 to Berger son -Caswell, Inc. for Deep Well No. 12 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmemher Helliwell , and upon vote being taken thereon, the following voted in favor thereof: Cnuncilmembers Helliwell. Ricker, Vasiliou. , and 7itiir The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted. The following members were present: Councilmembers Helliwell, Ricker, Vasiliou, and Zitur ' The following members were absent: Mayor Bergman Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 91- 31 REQUEST FOR PAYMENT NO. 16 AND FINAL C.S.A.H. 6 AND BRIDGE NO. 27679 CITY PROJECT NO. 250 WHEREAS, the City of Plymouth as owner and Richard Knutson, Inc., as contractor, have entered into an agreement for C.S.A.H. 6 and Bridge No. 27679, City Project No. 250, said agreement being dated July 21, 1988; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $2,584,985.16 three change orders were approved in the amount of $48,197.10 and the value of the work to date is $2,520,968.39 and is herewith approved. 2. That the work performed by the Contractor for C.S.A.H. 6 and Bridge No. 27679 and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 16 and Final in the amount of $34,266.41 to Richard Knutson, Inc. for C.S.A.H. 6 and Bridge No. 27679 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell. , and upon vote being taken thereon, the following voted in favor thereof: _ Councilmembers Helliwell, Ricker, Vasiliou, , and Zitur The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
