VILLAGE COUNCIL OF
PLYMOUTH, MINNESOTA.
Pursuant to due call and notice thereof, a tesqui - special meeting of the
Village Council of the Village of Plymouth was held on the 1st day of

Humnhrey introduced the following resolution and moved its

A RESOLUTION CONFIRMXNG AND ADOPTING
THE ASSESSMENT FOR
Kilmer Lane
WHEREAS, pursuant to due and proper notice according to law an assessment
hearing was held on the 1st day of October, 1969
relating to Street improvement, Kilmer Lane, Project #68 -SA
WHEREAS, all persons present desiring to be heard were heard and their objections,
it any, were noted
NOW, 'THEREFORE, BE IT HEFZBW RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
PZWNOUPH, MINNESOTA, AS FOLLOWS:
"l. The Village Clerk has, with the assistance of the Bonestroo & Associates
engineers heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for Street improvement, Kilmer
Lane, Project #68-8A
against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of land to be specially assessed
in the amount calculated against the same,
Z. Notice has been duly published as required by law that this council
. would meet in regular session at this time and place to pass on the
proposed assessment.
3. The proposed assessment has at all times since its filing been open to
. inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to s,ich proposed assessment, or to any item thereof, and
One objections have been filed.
4. This Oouncil finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of Kilmer Lane Street Improvement
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
5. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
• 6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special assessment for Kilmer Lane Street Improvement
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of 8% percent per annum.
S. Such assessments shall be payable in S equal annual installments
payable on the 1st day of January in each year, beginning in the year
19 20—, and continuing until all of sa;.d installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To sae first installment shall be
added interest on the entire assessment from the date hereof to
December 31, 19-U—, To each subsequent installment shall be added
interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County Auditor of Hennepin county a certified statement of the
• amount of all of such unpaid assesssents and the amount which will be
due thereon on the 1st day c_` January in each year.,,
The above motion was seconded by .:ouncilman Hintz and upon vote being
taken thereon, the following voted in favor thereof: Hayor Hilde, Councilmen Hintz,
Humphrey and ILindseth

Whereupon said resolution was declared duly passed and adopted.

therefrom.
