i Pursuant to due call and notice thereof, a regular meeting of the
village Council of the Village of Plymouth, Minnesota was held on the 22nd
{
day of September, 1969. The following members were present: Mayor Hilde,
Councilmen Kindseth, Hintz and Johnson. The following members were absent:
Councilman Humphrey.

+� Councilman Johnson introduced the following Resolution and moved its
adoption
RESOLUTION NO. 69-332
WHEREAS, in connection with the installation of a sanitary sewer pipe
over and across a portion of Lot 1, Block 1, Snyder"s Pine Ridge there is a
possibility that some damage may be done to four large trees on said property,
and
WHEREAS, the owners Patrick C. and Ann C. Wells have heretofore granted
and easement to the Village for the installatiop of such sanitary sewer, and
WHEREAS, in consideration of the'`granting of this easement the Village
has been presented with an agreement providing that.in the event of any damage
or destruction to such trees the maximum damages payable by the Village to
Patrick and Ant. Wells will be $250.00 per tree.
NOW THEREFORE BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH AS FOLLOWS:
1. That the Mayor and Clerk -Administrator of the
Village are authorized to execute such agreement
on behalf of the Village,
2. The Village Attorney is directed, following the
execution of such agreement, to process the
easement and complete the execution of the
agreement.
The motion for tha adaption of the foregoing Resolution was duly
seconded by Councilman Hintz, and upon vote being taken thereon, the following
voted in favor thereof: Councilmen Kindseth, Hintz and Johnson,
No one voted against. Mayor Hilde left the chambers.
Whereupon the Resolution was declared duly passed and adopted,
