HomeMy WebLinkAboutCity Council Resolution 1969-102EXTRACT OF MINUTES OF REGULAR MEETING OF VILLAGE COUNCIL OF VILLAGE OF PLYMOUTH, MINNESOTA Pursuant to due call and noticethereof a special meeting' of the Village Council of the Village of Plymouth, Minnesota was held on the 14th day of April, 1969 at the Village Hall, 13800 State Highway No. 55, beginning at 7:30 o'clock P.M. The following members were present: Mayor Hilde, Councilmen Humphrey, Hintz, Johnson and Kindseth. The following members were absent: None.. Councilman ,, introduced the de neon following resolution and moved its adoption. - "RESOLUTION doption:"RESOLUTION. NO. 69-102 A RESOLUTION EXPRESSING OPPOSITION TO MINNESOTA LEGISLATIVE HOUSE FILE NO. 1177 RELATING TO THE PLANNING AND CONSTRUCTION OF TRUNK HIGHWAYS SO AS TO REMOVE THE REQUIREMENT OF LOCAL CONSENT WHEREAS, there has been introduced into the House of Representatives of the Minnesota State Legislature a bill for an act relating to the planning and construction of trunk highways through`Municipalities, which bill is known and numbered as H. F. 1177 and, WHEREAS, said bill would repeal Minnesota Statutes 1967, Sections 161.17 Subdivision 1 and 160.08, Subdivision 2, sometime referred to as the "local consent" provisions and, WHEREAS, the Village Council of the Village of Plymouth has studied said proposed bill in some detail and has carefully considered the implications of suchproposed legislation as they irelate to municipalities and, WHEREAS, the Village Council of the Village of Plymouth does support a modification and change in the present local consent provisions of the law relating to the planning and construction of trunk highways and, WHEREAS, notwithstanding such desire to see said local consent provisions modified the Village Council of the Village of Plymouth opposes H. F. 1177 for the following reasons: 1. said bill places municipalities in a totally defensive position with respect to the planning and construction of trunk highways. 2. The procedures required by such bill in the event of disagreement between a municipality and the Cosmissioner of Highways are cumbersome, intricate, difficult of administration and would involve a dissenting municipality in significant and substantial expense for legal and engineering fees. 3. No opportunity is afforded to a dissenting municipality to have a representative on any arbitration board or decision making panel in the event of a dispute. NOW THEREFORE BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: 1. Said Village Cc-rcil '•i'orposed to the enactment of H. F. 1177 in it3 present form. 2. Said Village Council supports continued efforts to modify the present local consent laws in a manner consistent with effective administrative procedures and local participation. 3. The Clerk-]ftinistrator is directed to furnish certified copies of this resolution to the Honorable Henry J. McNight and the Honorable O. J. Heinita and to such other persons and public bodies as may be appropriate."
