HomeMy WebLinkAboutCity Council Resolution 2013-296CITY OF PLYMOUTH RESOLUTION No. 2013-296 A RESOLUTION TO APPROVE AN AMENDMENT TO THE STORM WATER UNDERGROUND FILTRATION SYSTEM MAINTENANCE AGREEMENT FOR CROSSROADS COMMONS (201 1014) WHEREAS, on June 26, 2012, the City of Plymouth executed a storm water underground filtration system maintenance agreement for Crossroads Commons located south of State Highway 55 between Cottonwood Lane and County Road 73; and WHEREAS, the affected property is legally described as: Lot 1, Block 1, Lot 1, Block 2, and Outlots A, B and C, Crossroads Commons, Hennepin County, Minnesota WHEREAS, McDonald's USA, LLC, owner of Lot 1, Block 2, Crossroads Commons has satisfied their storm water requirements on said site and entered into a maintenance agreement thereto, and are therefore requesting to be deleted from the maintenance agreement dated June 26, 2012 ; and WHEREAS, McDonald's Corporation has prepared an amendment to the June 26, 2012 agreement deleting Lot 1, Block 2 from that agreement; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth, the amendment to the storm water underground filtration system maintenance agreement dated June 26, 2012. ADOPTED by the City Council on September 10, 2013. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on September 10, 2013 with the original thereof on file in my office, and the same is a correct transcription thereof.
