HomeMy WebLinkAboutCity Council Resolution 1990-850CITY OF PLYMOUTH Pursuant to due call and notice thereof, a re lar meeting of tothe City Council of the City of Plymouth, Minnesota, was held on the 17th day of December , 192R. The following members were present: Mayor Bergman_ Councilmembers Helliwell. Ricker, Vagiliou and The following members were absent: None Mayor Bergman introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-850 AUTHORIZING THE PRIVATE SALE OF PARCEL 16-118-22-23-0066 TO ADJACENT PROPERTY OWNER WHEREAS, Hennepin County has provided the City with a list of non - conservation properties which have become tax forfeit as a result of nonpayment of property tax and/or special assessments; and WHEREAS, in accordance with the City Council's Tax Forfeit Land policy, each parcel has been reviewed; and WHEREAS, parcel 16-118-22-23-0066 does not serve a public purpose except as a storm water ponding area; and WHEREAS, the adjacent property owner has expressed an interest in acquiring the parcels to be used for open space, natural area, and ponding for the Plymouth Creek Development; and WHEREAS, the City Council is desirious of returning tax forfeit parcels to private ownership whenever possible. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does: 1. Declare Parcel No. 16-118-22-23-0066 to be unbuildable from a zoning and city code perspective. 2. Authorizes the private sale of said parcel to the adjacent property owner, in accordance with Hennepin County procedures. 3. Requires that the Homeowner Association execute covenants for the parcel, confirming that ponding and natural area it is to be forever used by the Homeowner Association for open space purposes and not development. The motion for adoption of the foregoing Resolution was duly seconded by Councilmemberl Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
