HomeMy WebLinkAboutCity Council Resolution 1990-834CITY OF PLYMOUTH Pursuant to due call and notice thereof, a _regular meeting of the City Council of the City of Plymouth, Minnesota was held on ttie lath day of December ; 1990. The following members were present: Mayor Bergman, Councilmembers Heliliwell, Ricker, Vasiliou, and 7itUr The following members were absent: None ' Coimcilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-834 REQUEST FOR PAYMENT NO. 17 AND FINAL T.H. 55 FRONTAGE ROAD/REVERE LANE CITY PROJECT NO. 815 S.J. GROVES, PHASE II CITY PROJECT NO. 648 WHEREAS, the City of Plymouth as owner and Enebak Construction Company, as contractor, have entered into an agreement for City Project No's 648 b 815, said agreement being dated September 14, 1988; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: I. That the original contract change orders were approved the value of the work to herewith approved. amount was $2,114,454.79 seven in the amount of $117,489.50 and date is $2,168,800.27 and is 2. That the work performed by the Contractor for City Project No's 648 and 815, and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 17 and Final in the amount of $45,583.80 to Enebak Construction Company, Inc. for City Project No's 648 and 815 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Cou cilmember Zitur and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou and_Zitur ' The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
