Pursuant to due call and notice thereof, a rPeilar meeting of the City
Council of the City of Plymouth, Minnesota was held on the 17th day of
_ Decemher , 1990. The following members were present: ,

The following members were absent: Mone
Cnimciln,w-mher Vasiliou introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 90-833
REQUEST FOR PAYMENT NO. 8 AND FINAL
T.H. 169 FRONTAGE ROAD IMPROVEMENTS
CITY PROJECT NO. 833
WHEREAS, the City of Plymouth as owner and Hardrives, Inc., as contractor,
have entered into an agreement for T.H. 169 Frontage Road Improvements, City
Project No. 833, said agreement being dated August 11, 1989; and
WHEREAS, the Engineer has certified his acceptance of the work and his
approval of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $456,330.96, four
change orders were approved in the amount of $15,177.55 and
the value of the work to date is $466,122.64 and is herewith
approved.
2. That the work performed by the Contractor for T.H. 169
Frontage Road Improvements, and certified to the Council by
the engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions of
the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after
final payment.
3. Request for Payment No. 8 and Final in the amount of
$35,520.47 to Hardrives, Inc. for T.H. 169 Frontage Road
Improvements is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same
forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon the following
voted in favor thereof: Mayor Bergman, Councilmembers Helliweli, Ricker,
Vasiliou, anj Zitur '
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
