PLn4DUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 17th day of December, 1990. The following members were present: _Mayor Bemoan. ce�unni Imam ers Hel 1 i Mel 1 , Ri cker, yMillou, and Zitur The following members were absent: None Mayor Bemoan introduced the following Resolution and moved its adoption: RESOLUTION 90-819 APPROVING MIXED PLANNED UNIT DEVELOPMENT CONCEPT PLAN FOR BERKSHIRE LANE I LIMITED PARTNERSHIP (TRAMMELL CROW COMPANY) F:._`. PLYMOUTH BUSINESS CENTER 5TH ADDITION (90063) WHEREAS, Berkshire Lane I Limited Partnership (Trammell Crow Company) has requested approval for a Mixed Planned Unit Development Concept Plan for Plymouth Business Center 5th Addition for property located at 34th Avenue North (extended) and Annapolis Lane (extended); and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Mixed Planned Unit Development Concept Plan for Berkshire Lane I Limited Partnership (Trammell Crow Company) for Plymouth Business Center 5th Addition for property located at 34th Avenue North (extended) and Annapolis Lane (extended), subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 3. A total of one density bonus point for the residential portion of the MPUD is assigned as follows: a. +2 for net open space in excess of 20% b. -1 for project size (35.8 acres) 4. No private drive access shall be permitted to Fernbrook Lane; a17. private drives shall be provided by internal public streets. 5. No approval is hereby granted for structure setbacks or other dimensional standards that are related to the Zoning or Subdivision Ordinance. All street rights-of-way will be dedicated with the initial Final Plat and park dedication will be in accordance with the Park Dedication Policy in effect at the time of filing the Final Plat. The motion for adoption of the foregoing Resolution was duly seconded by _ Gounciimemhor Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Manor Bergman_ Councilmnmhnrw The following voted against or abstained Whereupon the Resolution was declared duly passed and adopted.
