HomeMy WebLinkAboutCity Council Resolution 1990-795CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 10th day of December , 1990. The following members were present: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: _ None Council -member Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-795 REQUEST FOR PAYMENT NO. 2 45TH/46TH AVENUE TRAIL - ZACHARY LANE TO REVERE LANE CITY PROJECT NO. 024 WHEREAS, the City of Plymouth as owner and Bituminous Consulting and Contracting Company, Inc., contractor, has entered into an agreement for trail construction between Zachary Lane and Revere Lane known as City Project No. 024 said agreement being dated August 23, 1990; and WHEREAS, the contractor has requested a reduction in retainage to 2% based on completion of work as well as good weather this fall for turf establishment; and WHEREAS, the City Engineer concurs with the contractor's request and the City has the required one year maintenance bond guaranteeing all construction work. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $30,230.95 and the value of work completed to date is $30,637.48. 2. That Payment No. 1 was based on a 5% retainage, therefore, the total amount paid was $29,105.61. 3. Request for Payment No. 2 in the amount of $919.12 based on a reduction in retainage to 2% is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Counrilm mber Vasiliou , and upon vote being taken thereon, the following vol.ed in favor thereof: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
