HomeMy WebLinkAboutCity Council Resolution 1990-780CITY OT PLYMOUTH Pursuant to due call and notice thereof, a raqular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 10th day of Aar., Dacamhar, 1990. Rickert Va■i1+oL, and 2+tur The following members were absent: Nona GOunellmwmhor Zi , introduced the following Resolution and moved its adoption: RESOLUTION 90-780 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR LOWRY HILL CONSTRUCTION COMPANY (89106) (RPUD 81-4) WHEREAS, the City Council has approved the Final Plat and Development Contract for Lowry Hill Construction Company for "Deer Ponds," west of Zachary Lane and 250 feet south of 57th Avenue North; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Park dedication requirements for the Planned Unit Development shall be satisfied as follows: The developer will build the required trail; the City will apply for the required permit(s); and the developer will pay any costs associated with the permit(s) process. The Development Contract for Deerhaven and for Deer Ponds shall be amended as necessary to reflect this. This, plus the dedication of outlot B (the open wetland) and the approximate 300 feet of trail between 57th Avenue North and County Road 10, shall satisfy the park dedication requirement for the entire PUD. 3. No building permits shall be issued until a contract has been awarded for the construction of municipal newer and water. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. No yard setback variances are granted or implied. (see next page) Resolution No. 90-780 File 89106 Page Two 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 10. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 81-4 per Section 9 of the Zoning Ordinance. 11. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. 12. The Developer shall comply with those provisions of City Council Resolution 89-439 that apply. 13. The Homeowner's Association shall be a separate entity for Deer Pond and shall not be part of the original Homeowner's Association for Deer Haven. The motion for adoption of the foregoing Resolution was duly seconded by Councilmamhar Rickar , and upon vote being taken thereon, the following voted in favor thereof: _mayor BarOm�, councilmtiar■ Halliwall, Ricker, Vaailiou. and Zitur The following voted against or abstained No Whereupon the Resolution was declared duly passed and adopted.
