HomeMy WebLinkAboutCity Council Resolution 1990-774CITY OF ?LYNOUTH Pursuant to due call and notice thereof, a ;Acular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 10t day of December, 1990. The following members were present: Mayor BArQ�� [nunnilmamhwra Helliwell, Ricker, Vasil! ou, and Zitur _ The following members were absent: None er1 Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90-774 APPROVING CONDITIONAL USE PERMIT AND SITE PLAN FOR DAVEY TREE EXPERT COMPANY (90101) WHEREAS, Davey Tree Expert Company has requested approval for a Conditional Use Permit and Site Plan to enlarge the outdoor parking area and provide storage for both tree maintenance vehicles and nursery stock for property located at the northeast corner of Fernbrook Lane North and 25th Avenue North (2500 Fernbrook Lane North); and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Davey Tree Expert Company for a Conditional Use Permit and Site Plan to enlarge the outdoor parking area and provide storage for both tree maintenance vehicles and nursery stock for property located at the northeast corner of Fernbrook Lane North and 25th Avenue North (2500 Fernbrook Lane North), subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements within 12 months of the date of this resolution except as otherwise required by this resolution. 3. Any signage shall be in compliance with the Ordinance. 4. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 5. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 6. All waste and waste containers shall be stored within the enclosure, and no outside storage is permitted. (see next page) Resolution No. 90-774 File 90101 Page Two 7. All outside storage shall be contained in those areas identified on the approved plans. S. The new offatreet parking and storage area may be surfaced with crushed rock to be approved as to specifications by the City Engineer until June 15, 1991. Permanent curb and gutter and asphalt surfacing shall be in place June 15, 1991; otherwise, the Conditional Use Permit for outdoor storage of trucks, equipment, and nursery stock shall be null and void; all unpaved areas shall be sodded and all parking and vehicle circulation shall be limited to approved paved areas. The motion for adoption of the foregoing Resolution was duly seconded by Councilmembwr Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: 1Navor Eerg�n, Councilmambara Halliwell- Rinker, Vaailiou� and 2; tmr The following voted against or abstained xoae Whereupon the Resolution was declared duly passed and adopted.
