HomeMy WebLinkAboutCity Council Resolution 1990-773CITY Of PLUIOUTS Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 10tj1 day of December. 1990. The following members were present: Mayor Bergman. Councilmambarm Helliwell, Ricker, Vaailieu, and Zitur The following members were absent: None Councilmemb� Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90-773 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT AMENDMENT FOR ROBERT AND ANDREA NICHOLS FOR CIMARRON PONDS (RPUD 76-3) (90098) WHEREAS, Robert and Andrea Nichols have requested approval of a Residential Planned Unit Development Plan and Conditional Use Permit amendment to allow construction of a three -season porch for property located at 1090 Weston Lane North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Robert and Andrea Nichols for a Residential Planned Unit Development Plan and Conditional Use Permit amendment to allow construction of a 10' x 18' three - season porch for property located at 1090 Weston Lane North, subject to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no Code requirements are waived by this approval. 3. A finding is made that the proposed addition is within the ground co ger footprint (structure plus concrete patio) approved with the original RPUD Plan. As such, the degree of RPUD Plan amendment proposed is not of such scale as to alter the balance of Zoning Ordinance flexibility to PUD attributes found with the approved RPUD Plan. 4. The size of the porch structure shall be 10' x 18' as proposed. 5. Approval is subject to concurrence by the Cimarron Ponds Homeowner Association. The motion for adoption of the foregoing Resolution was duly seconded by Councilmamberyasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Ber®an. Councilmembers Hal i wall, Ricker, Vasi liou, and Z3itur The following voted against or abstained No.ie Whereupon the Resolution was declared duly passed and adopted.
