HomeMy WebLinkAboutCity Council Resolution 1990-743CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 5th day of Noverber___, 1920. The following members were present: Mayor Bergman,CouncilmembermHelliwell,_ Ricker, Vasiliou, and Zitur The following members were absent: None _ Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-743 AUTHORIZING THE CITY MANAGER TO ENTER INTO A SETTLEMENT AND MUTUAL RELEASE AGREEMENT WITH MEDICINE LAKE LINES AND REGIONAL TRANSIT BOARD WHEREAS, the City has retained $150,000 from payments which would otherwise have been made to Medicine Lake Lines for services rendered; and WHEREAS, such retainage was intended to protect the City against any audit claims made against Medicine Lake Lines by the Regional Transit Board, or Minnesota Department of Transportation in the event that the Company had insufficient assets to respond to such claims; and WHEREAS, Medicine Lake Lines has entered into an agreement with the Regional Transit Board whereby the Regional Transit Board is assigned all Medicine Lake claims against the City. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should, and hereby does, authorize the City Manager to enter into a settlement agreement with the Regional Transit Board and Medicine Lake Lines; and FURTHER, that the $150,000 heretofore held by the City shall be released to the Regional Transit Board in accordance with the agreement with the understanding that the City shall have no further liability with respect to audits for Plymouth Metrolink or Plymouth Dial -A -Ride service from July 1, 1983 through March 31, 1990, except for administrative expenses. The motion for adoption of the foregoing Resolution was duly seconded by Cou_nci member Vasiliou and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou,_.aa¢ The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
