Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 5th day of November 1990. The following members were present: Mayor Bergman, Councilmerrbers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 90- 721 REDUCING DEVELOPMENT BOND PLYMOUTH MEADOWS ADDITION (88112) WHEREAS, in accordance with the development contract dated April 17, 1989, David R. Dahl and Laurie J. Dahl, developers of Plymouth Meadows Addition (88112), has agreed r,-; install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site gradirig as noted below; and WHEREAS, the developer has requested a reduction of the development bond to reflect the completed work; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, 10 MINNESOTA; that the bonding requirements are reduced as follows: ITEM Street Construction ORIGINAL. AMOUNT $ 28,000 NEW AMOUNT $ 14,000 Sanitary Sewer 15,300 -0- Watermain 9,600 -0- Storm Sewer 10,000 -0- Boulevard and Drainage Swale Sod 1,500 500 Pond or Ditch Construction 1,000 1,000 Street Signs 150 150 Site Grading and Drainage Improvements 16,500 1,500 Park and Trail Improvements -0- -0- Design, Administration, Inspection, As-Builts 9,846 2.058 TOTAL $ 91,896 $ 19,208 That the letter of credit required for the above items be reduced as detailed above from $91,896 to $19,208 to reflect the completed work. Resolution No. 90- 721 Page Two FURTHER BE IT RESOLVED that the bonding requirements for the following items per Section 8.1 of the approved development contract be reduced as follows: ITEM Maintenance of Erosion and Sediment Control Plan Street Sweeping and Storm Sewer Cleaning Cash: Letter of Credit: ORIGINAL AMOUNT NEW AMOUNT $1,000 $1,000 $9,000 $4,500 FURTHER BE IT RESOLVED that the sanitary sewer, watermain, and storm sewer construction is accepted for continual maintenance as of November 5, 1990 subject to the One Year Guarantee by the developer. The motion for the adoption of the foregoing Resolution was duly seconded by Mayor Berman , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman Councilmembers Helliwell Ricker Vasiliou. The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
