HomeMy WebLinkAboutCity Council Resolution 1990-714CITY OF PLYMDDTR Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the nth day of November, 1990. The following members were present: Mayor Bergman, Counc, lm�ars Hell well, Ricker, VaAilinu„_and Zitur The following members were absent: None _ Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90-714 APPROVING SUBSTITUTE SECURITY FOR LANDSCAPE SURVIVABILITY FOR SCHUETT INVESTMENT COMPANY FOR "COACHMAN TRAILS" (85022) WHEREAS, a Site Plan for Schuett Investment Company was approved under City Council Resolution 85-398; and, WHEREAS, reinspection of the site resulted in the finding that some plantings had been relocated in deference to the amount of existing vegetation; and, WHEREAS, the City Council, by Resolution 90-546 approved an amended landscape plan for "Coachman Trails" showing the locations for 12 evergreen trees, 8 feet in height, to screen homes west of the site as being consistent with the intent of Condition 11 of Resolution 85-398; and, WHEREAS, Schuett Investment Company has requested substitution of the landscaper's one year warranty for the $20,000 cash deposit now held by the City to guarantee winter survivability of the 12 new evergreen trees. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINP,ESOTA, that it should and hereby does approve the use of the landscaper's one year warranty to guarantee winter survivability of the 12 evergreen trees to be planted on the "Coachman Trails" site responsive to City Council Resolution 90-546, subject to the following conditions: 1. The landscaper's warranty shall specifically name the City of Plymouth as the beneficiary. 2. Schuett Investment Company and its assigns and successors in ownership shall provide the City of Plymouth and its assigns right of entry upon the "Coachman Traila" property to replace trees, as required under the landscaper's warranty. FURTHER, be it resolved that release of the $20,000 cash escrow is authorized when all 12 new trees are planted in the locations specified on the approved plan, when the landscaper's warranty and the right of entry have been approved as to form by the City Attorney, and when the 3 trees which have died are replaced with like kind and size. The motion for adoption of the foregoing Resolution was duly seconded by Cou_ncilmownher Ricker , and upon vote being taken thereon, the following voted in favor thereof: _Mavor Beroman.
