Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 5th day of
November, 1990 The following members were present: Marcor Bergman,
Councilmembers Helliwell Zitur, Ricker, Vasiliou
The following members were absent: None
Councilmember Ricker introduced the following Resolution and
moved its adoption:
RESOLUTION 90-706
APPROVING AMENDED SITE PLAN AND ZONING ORDINANCE VARIANCES FOR CVN COMPANIES,
INC. FOR THE FORMER C.O.M.B.S. BUILDING (90096)
WHEREAS, CVN Companies, Inc. has requested approval for an amended Site Plan
and Zoning Ordinance variance to allow structure setback to 28th Avenue North
of 32.79 feet versus the Ordinance standard of 50 feet, and a Zoning Ordinance
variance for parking setback along 28th Avenue North of a minimum of 25 feet
versus the Ordinance standard of 50 feet for the former C.O.M.B.S. building
located at the northwest corner of 27th Avenue North and 28th Avenue North
(14605 28th Avenue North); and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CVN
Companies, Inc. for an amended Site Plan and Zoning Ordinance variance to
allow structure setback to 28th Avenue North of 32.79 feet versus the
Ordinance standard of 50 feet, and a Zoning Ordinance variance for parking
setback along 28th Avenue North of a minimum of 25 feet versus the Ordinance
standard of 50 feet for the former C.O.M.B.S. building located at the
nortl st corner of 27th Avenue North and 28th Avenue North (14605 28th Avenue
North), subject to the following findings and conditions:
1. Approval of the structure setback variance is based on a finding that the
Zoning Ordinance variance criteria are met.
2. Approval of the parking setback variance is based on a finding that the
Zoning Ordinance variance criteria are met.
3. The unsurfaced former outside storage area on the site shall be sodded as a
condition of this variance, unless a plan is approved by the City for
expanded off-street parking or the area is to be used consistent with the
prior approval for outside storage subject to all applicable conditions of
that approval.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Zitur and upon vote being taken thereon,
the following —voted in favor thereof: mor Bergman, Councilmembers
Helliwell Zitur Ricker Vasiliou -

Whereupon the Resolution was declared duly passed and adopted. _
