HomeMy WebLinkAboutCity Council Resolution 1990-700CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City ->f Plymouth, Minnesota, was held on the 15th day of October, 1990. The following members were present: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou, and The following members were absent: None Councilmember Ricker and moved its adoption: introduced the following resolution RESOLUTION NO. 90-700 ESTABLISHING A NATURAL PRESERVE PURSUANT TO PLYMOUTH CITY CODE, SECTION 810.03, SUBDIVISION 2 WHEREAS, Plymouth City Code, Section 810.03, Subd. 2, authorizes the City Council to declare certain private properties, or open space, as natural preserves to perpetuate their natural characteristics and qualities; and WHEREAS; the declaration of a natural preserve exempts a property from the Plymouth City Code 8 inch vegetation height maximum, but not from the requirement of eliminating noxious weeds; and WHEREAS, a request to declare a natural preserve has been received from the Board of Directors and property owners of Deerhaven Homeowner Association, located south of County Road 10, and west of Zachary Lane; and WHEREAS, the property owners have requested that the area immediately south of County Road 10 be declared a natural preserve under the City Code to maintain the natural environment, reduce erosion, and decrease noise levels associated with County Road 10 traffic; and WHEREAS, the City Council has considered this request and found that it is in accordance with City Code and does not create a hazardous or harmful situation from a public health and safety perspective. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does, declare a natural preserve to exist as recommended by the October 4, 1990 staff report, and contained in the attached graphic of that date, subject to the condition tht the reconstruction of County Road 10 may require modification or reconfiguration of the natural preserve by the City Council. Resolution No. 90-700 Page 2 The motion for adoption of the foregoing resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell Ricker, Vasiliog, and Zitur. The following voted against or abstained: None Whereupon the resolution was declared duly passed and adopted.
