HomeMy WebLinkAboutCity Council Resolution 1990-693CITY" OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 15th day of October , 1990. The following members were present: Mayor Bergman, Councilmemherc HP11iWP11� , Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-693 REDUCING DEVELOPMENT BOND TYRELL FIFTH ADDITION (87029) WHEREAS, in accordance with the development contract dated October 14, 1987, Hans Hagen Homes, Inc. developer of Tyrell Fifth Addition (87029), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the development bond to reflect the completed work; .NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the bonding requirements are reduced as follows: Street Construction (See Punch List Dated 8/2/90) $ 41,950 Sanitary Sewer -0- Watermain -0- Storm Sewer -0- Boulevard and Drainage Swale Sod 5,800 Pond or Ditch Construction -0- Street Signs 300 Site Grading and Drainage Improvements 20,000 Park and Trail Improvements -0- Design, Administration, Inspection, As-Builts 8,166 TOTAL $ 1,000 -0- -0- -0- 1,000 -0- -0- -0- -0- 240 $ 76,216 $ 2,240 That the letter of credit required for the above items be reduced as detailed above from $4,480 to $2,240 to reflect the completed work. Resolution No. 90-693 Page Two FURTHER BE IT RESOLVED that the bonding requirements for the following items per Section 8.1 of the approved development contract be reduced as follows: I Maintenance of Erosion and Sediment Control Plan Street Sweeping and Storm Sewer Cleaning Cash: Letter of Credit: $1,000 $1,000 $11,400 $5,700 FURTHER BE IT RESOLVED that the guarantee requirement for maintenance of erosion and sediment control plan street sweeping and storm sewer cleaning shall remain at $1,000 cash and Letter of Credit No. SB5758 remain at $5,700 until the silt from Lanewood Lane in the storm sewer and ditch south of 45th Avenue has been cleaned out. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman.
