Pursuant to due call and notice thereof, a rPg„iar meeting of the City
Council of the City of Plymouth, Minnesota was held on the icit-h day of

The following members were absent: _None
Councilmember Ricker introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 90- 681
AGREEMENT ON SPECIAL ASSESSMENT APPEAL
CITY PROJECT 648
WHEREAS, in October, 1989, the City Council assessed the O'Donnell parcel of
land for the 10th Avenue Improvement Project; and
WHEREAS, the property owners appealed this special assessment to District
Court; and
WHEREAS, the City and the property owner have negotiated an agreement to
settle this suit.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the agreement between Roy O'Donnell and Robert
Miller and the City of Plymouth be approved.
FURTHER, that the Mayor and City Manager are authorized to sign the agreement
on behalf of the City.
The motion for the adoption of the foregoing Resolution was duly seconded by

The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
