HomeMy WebLinkAboutCity Council Resolution 1990-651CITY OF PLINOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 15th day of October, 1990_ The following members were present: _Mayor Ber an Souncilmembers H61 iwe 1, Ricker, Vasiliou, and Zit „r The following members were absent:_ None Counci tme.,.r,er Va i7 i ou introduced the following Resolution and moved its adoption: RESOLUTION 90-651 DENYING APPEAL RULING OF THE BOARD OF ZONING ADJUSTMENTS AND APPEALS FOR UDO SCHULZ LOCATED AT 12265 48TH AVENUE NORTH (FILE 09-06-90). WHEREAS, Udo Schulz has appealed the Ruling of the Board of Zoning Adjustments denying a 62 foot Variance to allow a 13 foot setback versus the minimum Shoreland Management Setback of 75 feet, for an elevated play house structure, and, WHEREAS, The Board of Zoning Adjustments and Appeals have reviewed said appeal at a duly called public hearing on September 19, 1990 and denied the request; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the appeal by Udo Schulz and denies a 62 foot variance into the Shoreland Management Setback of 75 feet for the construction of an elevated "play house" structure at the property described as 12265 48th Avenue North for the following reasons and subject to the following conditions: 1. No particular hardship related to the physical surroundings, shape, or topographical conditions of this parcel have been demonstrated that create a particular hardship as distinguished as a mere inconvenience, if the strict letter of the regulations were to be carried out. 2. Relocation of the "play house" structure elsewhere on the property could be met within the Ordinance Setbacks. 3. The conditions upon which this petition for variation are based are not unique to this parcel of land. 4. This would establish an undesirable precedent for properties within the City. The motion for adoption of the foregoing Resolution was duly seconded by Coun i1M*MbA- Ricker , and upon vote being taken thereon, the following voted in favor thereof: Mavor Berm _ The following voted against or abstained CounciI*ee. hers Hell Whereupon the Resolution was declared duly passed and adopted.
