Councilmembers Helliwell. Ricker.. Vasiliou, and Zitur The following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved its adoption. RESOLUTION NO. 90-635 APPROVING APPEAL OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING FOR JEROME AND BETTY BEGIN FOR PIN 04-118-22-43-005 (FILE NO. 09-02-90) WHEREAS, Jerome and Betty Begin have appealed the ruling of the Board of Zoning Adjustments and Appeals regarding a variance for a 135' encroachment into the Shoreland Management Setback of 200', for the construction of the private picnic shelter on the west side of Pomerleau Lake and; WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed said request at a duly called Public Hearing on September 19, 1990 and denied the request; W THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the appeal by Jerome and Betty Begin and approves a 135' variance to allow a 65' Shoreland Management Setback for a private "picnic shelter" located at a property described as PIN 04-118-22-43-0005 for the following reasons and subject to the following conditions: 1. The Variance Criteria have been met. 2. A hardship exists because the structure was built inadvertently without the applicant's knowledge of the Shoreland Management Regulations. 3. The picnic shelter shall remain in its present condition and not be improved with the addition of screens, walls, sewage facilities, or indoor dividers or walls.
