Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 24th day of
September , 1990. The following members were present: ,
Mayor Bergman, Councilmembers Helliwell Ricker, Vasiliou, and Zitur
The following members were absent: None
Councilmember Ricker introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 90-610
REQUEST FOR PAYMENT NO. 5 AND FINAL
1989 STREET RECONSTRUCTION PROGRAM
CITY PROJECT NO. 801
WHEREAS, the City of Plymouth as owner and C.S. McCrossan Construction, as
contractor, have entered into an agreement for the 1989 Street Reconstruction
Program, City Project No. 801, said agreement being dated June 22, 1989; and
WHEREAS, the Engineer has certified his acceptance of the work and hie
approval of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOjVED BY THE CITY COUNCIL C`' THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $965,037.65 change
orders were approved in the amount of $118,701.60 and the
value of the work to date is $1,090,620.93 and is herewith
approved.
2. That the work performed by the Contractor for the 1989
Street Reconstruction Project and certified to the Council
by the engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions of
the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after
final payment.
3. Request for Payment. No. 5 and Final in the amount of
$62,696.53 to C.S. McCrossan Construction for the 1989
Street Reconstruction Project is hereby approved and the
City Finance Director is hereby authorized and directed to
pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by

The following voted against or abstained: No
Whereupon the Resolution was declared duly passed and adopted.
