HomeMy WebLinkAboutCity Council Resolution 1990-576CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 10th day of September , 1990. The following members were present: Mayor Bergman_ Counciluipmbprog Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-576 APPROVING AGREEMENT WITH THE MINNESOTA DEPARTMENT OF TRANSPORTATION AND THE SOO LINE RAILROAD FOR THE INSTALLATION OF GRADE CROSSING SIGNALS AT THE PINEVIEW LANE CROSSING OF THE SOO LINE RAILROAD CITY PROJECT NO. 935 WHEREAS, The Federal Highway Administration, when acting in cooperation with the State of Minnesota, is authorized by Section 130 of Title 23 of the United States Code to make federal aid available for the purpose of eliminating hazards at railroad grade crossing within the State of Minnesota; and WHEREAS, The City of Plymouth and the Soo Line Railroad Company desire that the Pineview Lane grade crossing of the Soo Line Railroad be provided with railroad flashing light signals with circuitry and the Soo Line Railroad Company is willing to install, maintain and operate such signals in accordance with the referenced agreement and WHEREAS, The State pursuant to Minnesota State Section 219.26 has reviewed the proposRd selection of warning devices for the railroad grade crossing and has determined that the proposed selection is appropriate for said crossing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the City of Plymouth enter into an agreement with the Soo Line Railroad Company and the Commissioner of Transportation for the installation and maintenance of railroad crossing signals at the intersection of Pineview Lane (MSAS 168) with the tracks of Soo Line Railroad Company in Plymouth, Minnesota, and appointing the Commissioner of Transportation agent for the City to supervise said project and administer available federal funds in accordance with Minnesota Statue, Section 161.36. The City's share of the cost shall be 10% of the total signal cost. The total estimated cost is $66,704 with the 10% local share being $6,670.40. It is understood that payment will be based on actual costs and not this estimated cost. BE IT FURTHER RESOLVED: That the Mayor and City Manager are hereby authorized to execute said agreement for and behalf of the City. FURTHER that funding for the project is allocated from the City's M.S.A. Fund (402-402) in the amount of $6,700. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman Counci lmembers Hglliwel 1;t�lcs�rFy a111mil , and Zitur The following voted against or abstained: Nnnp Whereupon the Resolution was declared duly passed and adopted.
