CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Plymouth, Minnesota, was held on the 10th day of septemb,ern go The
following members were present: Mayor Bergman, Councilmembers Helliwell
Ricker, Vasiliou, and Zitur

Councilmember Ricker introduced the following Resolution and moved its
adoption:
RESOLUTION 90- 544
DIRECTING AND ORDERING THE ABATEMENT OF A PUBLIC NUISANCE BY THE PROPERTY OWNER AT 13508
SUNSET TRAIL OF A PUBLIC NUISANCE BY THE PROPERTY OWNER AND AUTHORIZING THE CITY TO
CORRECT DEFICIENCY AND ASSESS COSTS, INCLUDING EXPENSES, AGAINST THE PROPERTY PURSUANT TO
CITY CODE SECTION 2010.
WHEREAS, Plumbing Inspector Don Kilian performed a site inspection at 13508 Sunset Trail
North, which revealed the presence of sewage effluent indicative of a failed individual
sewage disposal system on the property; and,
WHEREAS, the City Council has determined the condition of the property to constitute a
ublic nuisance and a public health and safety hazard; and,

p p y owner has been requested to remedy the deficiency by August 31,
1990; and,
WHEREAS, the system failure remains uncorrected and the public nuisance stili exists on
the property; and,
WHEREAS, notification and request for the abatement was sent to the owner by certified
mail and received on August 18, 1990; and,
WHEREAS, the owner has been notified of this hearing and has presented no reason why this
resolution should not be issued.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it finds that the condition of the property constitutes a public nuisance
and public health and safety hazard, and hereby does direct and order that the property
owner modify, repair or reconstruct the individual sewage disposal system on the property
no later than seven (7) days from the date of this resolution. The owner shall obtain all
necessary permits prior to commencing any work on the property.

IPURTHER, that if such work is not completed by the property owner within the time
established in this resolution, the City Manager is hereby authorized to abate the
nuisance in the manner set forth in Plymouth City Code Section 2010; if the estimated
costs of modifying, repairing, or reconstructing the sewage disposal system exceed 60
percent of the cost of connecting the house to the City sanitary sewer, then abatement
shall be accomplished by connection to the City sanitary sewer.
FURTHER, that all associated City costs and administrative fees shall be assessed against
the property in accordance with Plymouth City Code Section 2010, subdivision 5.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Vasiliou , and upon vote being taken thereon, the
following voted In favor thereof: Mayor Berman, Councilmembers Helltw11,
Ricker Vasiliou and Zitur The
