HomeMy WebLinkAboutCity Council Resolution 1990-504CITY of >PL7 N OUTH Pursuant to due call and notice thereof, a re- lar meeting of the City Council of the City of Plymouth, Minnesota, was held on the 20th day of August , 1990 The following members were present: Mayor Bergman un ova Hal 1 i wal 1 , Ricker, Vasiliou, a:ad Zitur The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90-504 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR LYMAN DEVELOPMENT FOR "PARKVIEW RIDGE 2ND ADDITION" (90060) (RPUD 88-3) WHEREAS, the City Council has approved the Final Plat for Lyman Development for "Parkview Ridge 2nd Addition" located at the northwest corner of Minnesota Lane and 38th Avenue North; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of the Final Plat. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. No yard setback variances are granted or implied. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. (see next page) Resolution No. 90-504 File 90060 Page Two 9. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 10. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 88-3 per Section 9 of the Zoning Ordinance. 11. The Grading and Site Plan shall be modified to include snow fence to define grading limits along the entire west property line with the intent to preserve existing trees beyond the area designated for grading. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergm n, Councilmembers Helliwell, Ricker, Vasiliou,_ and Zitur The following voted against or abstained None _ Whereupon the Resolution was declared duly passed and adopted.
