Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 6th day of

Mayor Bergman, Councilmembers Helliwell. Ricker, VaG lion, and Zitur ,
The following members were absent: None
Councilmember Vasiliou introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 90-486
APPROVING STIPULATION OF SETTLEMENT
PLYMOUTH VERSUS WILLIAM J. CAVANAUGH
CITY PROJECT NO. 853
WHEREAS, Part of the public improvement project on Vicksburg Lane between
Highway 55 and County Road 9, it was necessary to acquire right-of-way from
the parcel of land owned by William J. Cavanaugh; and
WHEREAS, in order to obtain the necessary right-of-way, the City condemned the
property and the Commissioners made an award for damages in 1980; and
WHEREAS, the City appealed the Commissioner's award to the District Court; and
WHEREAS, the City of Plymouth and William J. Cavanaugh have negotiated a
settlement for obtaining the necessary right-of-way;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the City Manager is authorized to execute the
"Stipulation of Settlement" in the sum of $77,500.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur and upon vote being taken thereon, the following
voted in favor thereof: Mayor Bergman. Councilmembers Helliwell. Ricker. ,
Vasiliou,_and Zitur
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
