Pursuant to due call and notice thereof, a regular . meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 16th day of

moved its adoption:
RESOLUTION 90-428
APPROVING MIXED USE PLANNED U11IT DEVELOPMENT PRELIMINARY PLAN/PLAT/CONDITIONAL,
USE PERMIT FOR MANS HAGEN HOMES/WESTAR-ROME PARTNERS (90029)
WHEREAS, Hans Hagen Homes/Westar-Rome Partners has requested approval for a
Mixed Use Planned Unit Development Preliminary Plan/Plat/Conditional Use
Permit for property located at the southwest and southeast quadrants of Medina
Road and County Road 24; and,
WHEREAS, the Planning Ccmmission has reviewed the request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNT -IL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does apFrove the request by
Hans Hagen Homes/Westar-Rome Partners for a Mixed Use Planned Unit Development
Preliminary Plan/Plat/Conditional Use Permit for property located at the
southwest and southeast quadrants of Medina Road and County Road 24, subject
to the following conditions:
1. Compliance with the City Engineer's Memorandum, except Item 24.0. as
modified by Condition No. 11 of this resolution.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. No building permits shall be issued until a contract has been awarded for
sewer and water.
4. Provisions for a 30 -foot wide trail easement along County Road 24 per
Comprehensive Park Plan, as verified by the Parke and Engineering
Departments, with submittal of detailed plans as to construction of the
trail per City standards with the initial Final Plat.
5. Payment of park dedication fees -in -lieu of dedication with appropriate
credits in an amount determined according to verified acreage and paving
cots and dedication of .86 net acres for a neighborhood park and
' according to the Dedication Policy in effect at the time of filing the
Final Plat with Hennepin County.

6. street names shall comply with the City Street Naming System.
7. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
8. Rezoning shall be finalized with the filing of the Final Plat.
9. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
10. Approved setbacks for residential lots are 35 feet front except Medina
Road and County Road 24; 10 feet side and 25 feet rear. Exceptions may be
approved for specific lots based only on a demnnatrated perservation of
natural site features directly related to the reduced setback.
Approved setbacks for lots lying east of County Road 24, south and
adjacent to Medina Road are 50 feet to house living areas and 35 feet to
garages based on landscape/grading plan submitted with the Preliminary
Plan which provides for upgrading and developer -supplied special
landscaping adjacent to Medina Road.
11. Residential private drive access shall be limited to internal public roads
and restricted from County Road 24 and Medina Road.
12. Appropriate legal documents regarding Homeowners' Assaciation documents,
covenants and restrictions as approved by the City Attorney, shall be
filed with the Final Plat.
13. No project monument signage is proposed or approved by this action.
14. The Final Plat shall integrate the land shown as Outlot E with the
abutting properties.
15. Approval is conditioned on the concurrence of the Metropolitan Council
with Land Use Guide Plan amendments affecting this site previously
approved by the City Council.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilme_mher Zitur , and upon vote being taken thereon,
the follow4.ng voted in favor thereof: Coi2nnJJM=MIberm Helliwell, Ricker,
Vasiliou, and Zitur _
