HomeMy WebLinkAboutCity Council Resolution 1990-427CITY Or PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 16t day of Jmly_, 192Q_ The following members were present: Couneilmembers Halliwell, Ricker, Vasiliou, and Zitur The following members were absent:_ Mayor Beroman rte++gni or Eitur introduced the following Resolution and moved its adoption: RESOLUTION 90-427 APPROVING MIXED USE PLANNED UNIT DEVELOPMENT CONCEPT PLAN FOR HANS HAGEN HOMES/WESTAR-ROME PARTNERS (90029) WHEREAS, Hans Hagen Homes/Westar-Rome Partners has requested approval for a Mixed Use Planned Unit Development Concept Plan for property located at the southwest and southeast quadrants of Medina Road and County Road 24; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hans Hagen Homes/Westar-Rowe Partners for a Mixed Use Planned Unit Development Concept Plan for property located at the southwest and southeast quadrants of Medina Road and County Road 24, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum, except Item 24.0. as modified by Condition No. 5 of this resolution. 2. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 3. Maximum density shall be 1.775 units per acre for the land at or above the established high water elevation per the adopted City Storm Water Drainage Plan as verified by the City Engineer. 4. Draft restrictive covenants for the private open areas shall be submitted with Preliminary Plat/Plan application. 5. No private drive access shall be permitted to Medina Road and County Road 24 from residental units; all private drives shall be provided by internal public streets. No specific position is taken with respect to private access from commercial/industrial units pending submission of complete Final Site Plans for commercial/industrial development on the areas of the site so guided and zoned. No approval is hereby granted for structure setbacks or other dimensional standards that related to the zoning or Subdivision Ordinance. 7. Approval is conditioned on the concurrence of the Metropolitan Council with Land Use Guide Plan amendments affecting this site previously approved by the City Council. 8. Approval is conditioned on the concurrence of the City Council in the alignment of County Road 24 and Medina Road in this area. 9. A cul-de-sac shall be constructed at the south end of Holly Lane. The City Engineer"s recommendation with respect to an emergency access from the south end of the cul-de-sac to County Road 24 is concurred in. The motion for adoption of the foregoing Resolution was duly seconded by Deputy Mayor Vasilinu , and upon vote being taken thereon, the following voted in favor thereof: Councilmembers Helliwell, Zitur, and Vasiliou The following voted against or abstained Councilmllaber. Ricker Whereupon the Resolution was declared duly passed and adopted.
